![]() In 1998, a Schenectady County jury convicted Jeanty, a prior felon from Queens, of second-degree murder, first-degree robbery, first-degree burglary and assault for the Mahome invasion at the victims' home in the GE Realty Plot neighborhood. ![]() Garry said Jeanty, who was representing himself, was “misplaced” in basing his legal argument on a section of criminal procedure law because the rule Jeanty cited applied to civil actions to enforce money judgments - not criminal restitution obligations. She said the state Department of Corrections and Community Supervision (DOCCS) was required to comply with the terms of the order until Jeanty’s restitution was paid or the order was amended. Presiding Justice Elizabeth Garry, who authored the decision, said Jeanty’s sentence and other documents required that he pay $19,581 in restitution to be collected from Jeanty’s wages in prison. In a 5-0 decision, the Appellate Division of state Supreme Court’s Third Department said no.
